[EXT. VARIOUS MIAMI CITY LIGHTS (STOCK) -- NIGHT]

INTERCUT WITH:

[EXT. MIAMI BEACH - NIGHT]

(A MAN leads a blonde-haired WOMAN out through the white-picket fence to the
beach.)

(The man is carrying a green bottle of champagne. They walk to the end of the
short wooden walk to the beach.)

(He points to the side and leads her there.)

(The man and the woman sit side-by-side on the beach staring out at the ocean
talking with each other.)

(Cut to: The Man talks and smiles.)

(The Woman looks at him and smiles.)

(Cut to: The Open Fabinger Champagne bottle. The woman puts her hand on the
Man's thigh. They look at each other.)

(The Man caresses the Woman's arm and shoulder. He touches her cheek and they
move closer to each other.)

(They finally kiss.)

CUT TO:

(Close-up of a pair of feet walking in the sand. The person walks faster and
faster till the person is running.)

(Cut to: The Man and The Woman are kissing, intent on each other.)

(An arm breaks camera frame and clubs the man on the back of his head with
something heavy.)

(The Man falls on the Woman. She starts screaming.)

(The person pushes the Man off of the Woman and holds her down as she
struggles.)

(The Man gets up to help, but is hit across the face by an attacker.)

(The Woman struggles.)

FLASH TO:

[EXT. MIAMI BEACH - DAY]

(The Man is lying face-up on the sand. Officers stand off to the side, crime
scene tape cordons off the area. Horatio and Megan approach the scene.)

HORATIO: Good morning.

DET. FENWICK: This will do wonders for tourism.

HORATIO: Yes.

(Megan sighs.)

HORATIO: Who called it in?

(They approach the body.)

DET. FENWICK: A jogger from the Loews found the victims at 6:15.

MEGAN: "Victims"? I'm only seeing one victim.

(Det. Fenwick points down toward the beach.)

DET. FENWICK: No, there was a girl down there, a Jane Renshaw, age 24, here
from Iowa. She was beat to hell, unconscious, and half drowned. She's over at
St. Luke's.

(Horatio kneels down next to the body and looks at the wound.)

HORATIO: Well, they made sure he was dead. You get an ID?

DET. FENWICK: No. She was too out of it to help.

HORATIO: Mmm-hmm. (Horatio notices the victim's bare feet and the direction
that the footprints are coming from.) He was running away.

MEGAN: Why kill a guy who's running from the scene?

HORATIO: Yes ... therein lies the rub, my friends ... (The camera focuses in on
the victim's neck wound.) ... for the evidence, as always will speak for
itself.

(Several flash pulses on Horatio.)

END OF TEASER.

FADE IN.

[EXT. VARIOUS MIAMI CITY (STOCK) - DAY]

[EXT. BEACH - DAY]

(Alexx examines the body as Megan and Horatio wait.)

ALEXX: (to the body) Why'd you die so far from the girl, heh?

HORATIO: What's he telling you, Alexx?

(Horatio walks around the body.)

ALEXX: Sustained blunt-force trauma to the head.

(Quick flash of: [BEACH - NIGHT] Someone hits the Man on the back of the neck.
End of flash. Resume to present.)

ALEXX: Multiple blows, based on the blood. Liver temperature is 87.2.

MEGAN: So he died around midnight.

ALEXX: Jugular. Not a knife, though.

(Camera extreme close-up to the neck wound.)

ALEXX: Irregular object. Bled out.

(Quick flash of: [BEACH - NIGHT] The MAN is still alive, his wound bleeding.
End of flash. Resume to present.)

(Horatio looks down and sees something.)

HORATIO: What's this mark on his cheek right there?

(Camera close-up of a black circular mark on the victim's right cheek.)

(Alexx leans forward and looks at it.)

ALEXX: Burn mark. A little bit of ash and something brown.

(Horatio steps away from the body for a moment.)

HORATIO: Smashing and slashing aren't enough. Gotta burn him, too, huh?

(Alexx takes a swab of the burn mark.)

MEGAN: If I'm going to mess somebody up like this I don't do it out in the
open.

HORATIO: Mmm. Unless you're not worried about it.

(Horatio looks around the area and sees the closed-up lifeguard tower.)

(Cut to: Horatio finds some hair on the ramp leading up to the lifeguard tower.
He looks at it.)

HORATIO: Male victim's hair is black.

(He puts it in a bindle.)

(Megan is looking at the blanket left on the beach near the tower.)

MEGAN: Yep. Got blonde here just like the female vic. So, our guy and girl
grab a blanket have a little fun in the moonlight.

HORATIO: Until they are rudely interrupted.

(Quick flash of: [BEACH - NIGHT] The Man's head is slammed up against the life
guard tower ramp. He's clubbed on the back of the head again.)

(End of flash. Resume to present.)

MEGAN: She's assaulted tossed in the ocean, left to die.

(Quick flash of: [BEACH - NIGHT] The Woman is dragged into the water face-
down. The tide rolls in.)

(End of flash. Resume to present.)

HORATIO: The guy tries to escape.

(Quick flash of: [BEACH - NIGHT] The Man stumbles to his feet and runs.)

(End of flash. Resume to present.)

HORATIO: Half dead, scared out of his mind he runs ... and someone catches up
to him over here. So that makes these the last footsteps of his life.

(Megan's phone rings. She answers it.)

MEGAN: (to phone) Megan Donner. (pause) Be right there.

(Megan hangs up.)

MEGAN: SART nurse. They've completed her exam. We can talk to her now.

HORATIO: Keep me posted.

MEGAN: Got it.

CUT TO:

[EXT. BEACH - DAY]

(The Coroners lift the gurney with the bagged body on it and carry it off the
beach. In the background, we see Calleigh walking toward the crime scene. She
greets Alexx on her way in.)

(In the foreground, Delko and Speedle are sifting through the beach sand.
Calleigh walks up to them.)

CALLEIGH: (cheerfully) Who wants to help me search around the girl?

(Instant scoffing from the guys.)

SPEEDLE: We're working on the murder scene. You asked for the girl?

CALLEIGH: I like a challenge. Tide could come in at any moment.

(Calleigh turns and leaves. Delko chuckles.)

SPEEDLE: Too much. Hey, check this out.

(Speedle holds out a piece of green glass.)

DELKO: What do you got?

SPEEDLE: Still sharp, no erosion.

DELKO: Damn good chance that could be from last night.

(Speedle looks at it.)

SPEEDLE: Yeah.

(He reaches for his kit.)

CUT TO:

[INT. ST. LUKE'S HOSPITAL -- HALLWAY - DAY]

(Megan talks with the SART Nurse on the way to Jane Renshaw's room.)

SART NURSE: This is everything she had on.

MEGAN: Any indication of rape?

(They turn the main reception area and we see that Megan holds her kit in one
hand and a package in the other.)

SART NURSE: Recovered what looks like semen. Tears on the lower part of her
vagina. Six, seven and eight o'clock. Also a grade three concussion.

MEGAN: She give you a name?

SART NURSE: She suffered a pretty severe trauma. She doesn't remember the last
twelve hours.

(The SART Nurse opens the room door and stops.)

SART NURSE: Oh, listen. She got antsy when I tried to administer an oral swab.

(Megan looks past the nurse over at Jane in the room.)

MEGAN: Sense memory.

SART NURSE: (nods) She's repressing. And she's right on the edge.

MEGAN: I'll see what I can do.

SART NURSE: Thanks, Megan.

(Megan steps into the room.)

[INT. ST. LUKE'S HOSPITAL - JANE RENSHAW'S ROOM - DAY -- CONTINUOUS

(Megan walks into the room.)

MEGAN: Hi, Jane. My name's Megan Donner. I'm a Crime Scene Investigator.

(Jane turns and looks at Megan, but doesn't say anything for a moment. Megan
turns and puts her things down.)

JANE RENSHAW: They said I was attacked.

(Megan sighs.)

MEGAN: We don't know by whom.

JANE RENSHAW: They won't tell me if my boyfriend, Paul, is okay. Paul
Varnette.

(Megan notes the name.)

MEGAN: We don't know yet. Uh ... right now I'd like to concentrate on you.

(Jane takes a deep breath.)

MEGAN: We have evidence of a sexual assault. If we're going to find the person
who did this to you, I need your help. The more evidence we collect from you,
the better our chance of catching him. Would you let me complete the exam?

(Jane looks at Megan and nods.)

MEGAN: Thanks.

(Megan opens her kit and puts on a pair of gloves. She takes out a swab. She
points to her mouth.)

MEGAN: Can you open?

(Jane opens her mouth slightly.)

MEGAN: That's good. That's good.

(As she takes the swab, Jane takes a shuddering breath. Megan notes something.)

MEGAN: Do you wear a retainer?

JANE RENSHAW: (swallows and nods) Mm-hmm.

MEGAN: Would it be okay if I removed it?

(Jane removes the retainer herself. Megan takes the retainer from Jane.)

(Megan looks at the retainer and sees something.)

(An extreme close-up of the center of the retainer shows something there.)

MEGAN: Uh ... I'm going to, um ... take this for now, okay?

JANE RENSHAW: (nods) Mmm.

MEGAN: Detective Fenwick will be here in a few minutes. He needs to ask you
some questions about Paul.

(Megan nods; Jane nods.)

MEGAN: I'll be right outside.

(Jane nods.)

CUT TO:

[EXT. MIAMI CITY (STOCK) - DAY]

[INT. CSI CRIME LAB - LAB -- DAY]

(Calleigh walks into the lab. She finds Delko there.)

CALLEIGH: What are you up to?

DELKO: Sand's from the hot area around the male victim.

(Calleigh walks past Delko to the other counter.)

CALLEIGH: Didn't you already sieve around that area?

DELKO: Yeah, but, uh, there was a struggle and the paramedics came through.
Sometimes things get buried so I dug a little deeper.

(Calleigh puts the envelope up on the shelf. She walks out of the locker and
back toward Delko. )

CALLEIGH: Oh, my gosh, aren't you ambitious?

(Delko swabs a small piece of plastic.)

DELKO: Here, look at this.

CALLEIGH: Nosepiece from eyeglasses.

DELKO: That's right.

(Delko tests for blood.)

DELKO: A little phenol ... ... and some of this...

(The swab tests positive.)

CALLEIGH: This ... proof of blood. Pink always was my favorite color.

DELKO: I'll get this over to DNA.

CALLEIGH: (cheerfully) Oh, I'll take it. I'm going that way anyway.

(She takes the package.)

DELKO: You sure?

CALLEIGH: Yeah.

DELKO: Great.

(Calleigh turns and leaves.)

CUT TO:

[INT. CSI - FORENSIC AUTOPSY - DAY]

(Alexx examines the male body. She finds something in the neck. Horatio
watches from above.)

ALEXX: Something in the neck wound.

(She pulls the piece out and holds it up to the monitor so Horatio can see it on
the screen up above.)

ALEXX: Looks like glass.

HORATIO: We found a lot of broken glass at the scene.

(He taps out something on the keyboard and a map appears.)

HORATIO: Approximately five meters from the victim's body. Is your glass green
in color?

ALEXX: Copy that.

(Alexx puts the glass in a petrie dish and sets it aside.)

HORATIO: Hmm. So that means somebody jabbed our guy with a broken bottle,
doesn't it?

ALEXX: Interesting because I'm thinking he was a bartender.

HORATIO: Based on?

ALEXX: Lime peel in his fingernails and these rashes.

(Alexx holds the back of the body's hand toward the camera so Horatio can see it
on the monitor.)

ALEXX: Occupational dermatosis. You can get it from squeezing a lot of lemons
or limes in direct sunlight.

(Horatio puts the back of the hand view up on screen.)

HORATIO: The female victim stated that her boyfriend was a CPA.

ALEXX: Maybe he moonlights.

(Horatio pulls up a profile of Paul Varnette up on screen.)

HORATIO: It also says the boyfriend has light brown hair.

ALEXX: This guy's is black.

HORATIO: Check his eye color, please.

(Alexx turns the body's head and checks the eyes.)

ALEXX: Green.

HORATIO: CPA has brown. You know what that means?

ALEXX: This ... ain't her boyfriend.

HORATIO: This ain't her boyfriend, but it might be why he's on your table,
Alexx. Thank you.

(Horatio makes a call.)

HORATIO: (to cell phone) Detective Fenwick, this is Horatio Caine. (Horatio
starts to leave the lab.) Meet me at the female victim's hotel, the Agramonte.
That's right, the Agramonte. I'm on my way. (He hangs up.) (louder) Thank
you, Alexx.

(Horatio leaves.)

CUT TO:

[INT. AGRAMONTE - VARNETTE'S ROOM -- DAY]

(Paul Varnette empties his pockets on the dresser. Behind him, the door opens.
Detective Fenwick and Horatio Caine walk into the room surprising Varnette.)

PAUL VARNETTE: Hey, who are you guys?

DET. FENWICK: Paul Varnette?

PAUL VARNETTE: What's going on?

HORATIO: Well, Paul, your girlfriend, Jane, is in the hospital and the guy she
was with last night is dead and you look like you've been up all night, so why
don't you tell me?

(Camera holds on Paul Varnette's surprised look.)

FADE TO BLACK.

(COMMERCIAL SET)

FADE IN

[EXT. OCEAN (STOCK) - DAY]

[EXT. VARIOUS MIAMI CITY (STOCK) - DAY]

[INT. AGRAMONTE - VARNETTE'S ROOM -- DAY]

(Horatio is looking at digital camera pictures of Jane. He glances at Paul
Varnette who is sitting on the side looking shaken by the news about Jane.
Horatio sits down near Paul.)

(Megan walks into the room.)

MEGAN: Hey, Fenwick. Got here as fast as I could.

(Megan hands Horatio an envelope.)

HORATIO: Traffic on the causeway. Hmm.

PAUL VARNETTE: I can't believe someone did this to Jane.

DET. FENWICK: When was the last time you saw her?

PAUL VARNETTE: Maybe eleven. We were at a party and ...

(Horatio reaches out and removes a high-priced cigar from Paul's shirt pocket.)

PAUL VARNETTE: ... I passed out. I woke up at the guest house an hour ago.

HORATIO: Mm, cubanos? These are illegal, you know.

PAUL VARNETTE: I got them from a guy at the airport.

HORATIO: I'm going to take them into evidence if you don't mind.

(Horatio takes the other cigar and slips them into an envelope.)

PAUL VARNETTE: I don't understand.

HORATIO: Not important that you do.

MEGAN: How did you get those cuts on your hands?

PAUL VARNETTE: I ... don't know. I was drunk. The Hamilton's throw a good
party.

MEGAN: The Hamilton's? Governors, Senators, war hero Hamilton's?

PAUL VARNETTE: Yeah. I went to business school with Tyler Hamilton at
Vanderbilt. He always said if we were in Miami, we had an open invitation.

HORATIO: Pretty girl like Jane, I don't doubt it.

PAUL VARNETTE: You know the family?

HORATIO: I do. Have you, um ... ever seen him before?

(Horatio shows a photo of the dead man to Paul.)

PAUL VARNETTE: No.

HORATIO: Hmm.

PAUL VARNETTE: Look, I haven't done anything. I never saw this guy and I never
hurt Jane.

HORATIO: Paul, did you teach Jane a lesson for stepping out on you?

PAUL VARNETTE: No. No way.

MEGAN: Then you wouldn't mind giving us a DNA sample to rule you out?

PAUL VARNETTE: No problem. But listen ... Jane and I did have sex recently.

HORATIO: How recently?

PAUL VARNETTE: Yesterday before the party.

(Megan leans in with a swab.)

MEGAN: Open up.

(She takes a swab sample from Paul's mouth.)

HORATIO: (to himself) Yesterday ...

MEGAN: Thank you.

PAUL VARNETTE: We were playing around and things got kind of rough. If you
find anything ...

HORATIO: You'll be the first to know. (to Megan and the Det.) Oh, this guy is
a friend of the Hamiltons. Let's not let him out of our sight, okay?

CUT TO:

[EXT. MIAMI BEACH (STOCK) - DAY]

[EXT. HAMILTON ESTATE - DRIVEWAY -- DAY]

(Workers are working on the landscape. Horatio presses the intercom button.)

HORATIO: Horatio Caine.

MAN (on intercom) Come ahead.

HORATIO: Thank you.

(Horatio walks up to the closed gate. Calleigh, Delko and Det. Fenwick follow.)

(Horatio notes the worker setting up the American flag on the second floor.)

(Horatio turns and sees Calleigh and Delko approach. He notices that Calleigh
is wearing a very smart suit.)

HORATIO: (to Calleigh) Nice suit.

CALLEIGH: I'm pulling out my fall stuff.

HORATIO: I heard you got something from the beach.

CALLEIGH: A nose piece with blood evidence. The lab has it now.

HORATIO: Hmmm

CALLEIGH: I'm surprised the Hamiltons are still here. Usually they're in
Vermont this time of year.

HORATIO: hmmm.

CALLEIGH: It's almost peak foliage.

DELKO: Calleigh, you seem to know as much about this family as you do about
nine millimeters.

CALLEIGH: They're American royalty. What can I say?

HORATIO: Mm-hmm. Eric, stay off their property but take a look around.

DELKO: You got it, H.

(The front gates begin to open. Delko takes off. Horatio. Calleigh and Det.
Fenwick head up the drive toward the house.)

HORATIO: Here we go.

CUT TO:

[INT. HAMILTON RESIDENCE - FOYER - DAY - CONTINUOUS]

(Drake Hamilton opens the front door.)

DRAKE HAMILTON: Horatio, good to get your call. (They shake hands.) I don't
think you've been here since ...

HORATIO: (interrupts) It's been a while.

DRAKE HAMILTON: Yeah.

(Horatio steps into the house and introduces the others.)

HORATIO: Calleigh Duquesne, Detective Fenwick.

DRAKE HAMILTON: Nice to meet you all. Please come in. Sorry about the
circumstances. Any leads on that beach attack? (Drake closes the door behind
them.) It's all over the news.

HORATIO: Actually we think the victims were at your party last night.

DRAKE HAMILTON: You're kidding?

HORATIO: No, I'm not.

DRAKE HAMILTON: Well, it wasn't my party. It was my nephew Tyler's.

HORAITO: Hmm.

DRAKE HAMILTON: Past my bedtime.

DET. FENWICK: We'd like to talk to him.

DRAKE HAMILTON: Certainly. Right this way.

(Drake leads Det. Fenwick outside.)

CUT TO:

[EXT. HAMILTON RESIDENCE - BACKYARD - DAY - CONTINUOUS]

(Horatio, Calleigh and Det. Fenwick interview Tyler Hamilton.)

TYLER HAMILTON: (nods) Yeah, Paul's a buddy of mine from school. His
girlfriend's the woman that got raped?

HORATIO: That's right.

TYLER HAMILTON: Geez. So, who's the guy who got killed?

(Horatio shows the photo to Tyler.)

HORATIO: We think he may have tended bar at your party last night.

TYLER HAMILTON: I-I don't recognize him.

HORATIO: No?

TYLER HAMILTON: But if she's okay can't she tell you who he is?

HORATIO: We're looking at that.

DET. FENWICK: Paul says he didn't go down to the beach last night -- that he
slept in your guest house.

TYLER HAMILTON: Yeah, he was pretty messed up. I let him crash.

HORATIO: You mind if I look at the guest house to confirm his story?

DRAKE HAMILTON: I'm afraid I wouldn't be comfortable with that, Horatio.

HORATIO: We are merely trying to find evidence that could exonerate your
friend.

DRAKE HAMILTON: And we're cooperating. Tyler will tell you everything that he
knows. But if you want to conduct a search -- legally you need a warrant.

(As they talk, Calleigh walks around the grounds.)

HORATIO: That's true.

CALLEIGH: Horatio?

HORATIO: Yeah.

(Calleigh notices the green champagne bottle on the small table.)

CALLEIGH: Interesting bottle. The green glass is similar to the glass we found
in our male victim.

(Calleigh walks up to Drake Hamilton.)

DRAKE HAMILTON: Every house on this beach serves that kind of champagne. Every
wine and liquor store in the area sells it. Look, if I let you take it, then
the tabloids will be calling this a raid. I won't put my family through that.

CALLEIGH: Mr. Hamilton a terrible thing has happened just outside your property
line.

DRAKE HAMILTON: Well, just like that attack on Hobe Beach. Horatio, you know
what Miami has turned into. Look at the gangs before you point to my family ...
or our friends.

HORATIO: I'll keep that in mind.

CUT TO:

[EXT. HAMILTON RESIDENCE - FRONT DRIVE - DAY - A LITTLE LATER]

(Horatio, Calleigh and Det. Fenwick are walking back to their cars.)

DET. FENWICK: State's attorney's office says we might be able to get a warrant
for this place.

HORATIO: Okay.

DET. FENWICK: At least the guest house.

HORATIO: We have one chance to get a warrant against these people. The first
judge that turns us down, we're dead so let's motor on that. (Delko meets up
with them.) What do you got?

(Delko's PDA beeps.)

DELKO: I got the name of a bartender who left early last night and still hasn't
shown up to collect his share of the tips. (He checks his PDA.) It's Estevan
Ordonez. Guatemalan, temporary visa, no relatives.

HORATIO: Black hair, green eyes?

(Delko shrugs.)

HORATIO: I'll tell you later.

(Horatio moves. Delko smiles. Amazing.)

CUT TO:

[INT. CSI - CRIME LAB -- DAY]

(Speedle is in the lab reconstructing the green champagne bottle from the bits
of green glass collected from the beach.)

(He finishes the base of the bottle.)

(He fumes the base of the bottle.)

(When he's done, he finds a finger print on the glass.)

(Speedle runs the print through the database.)

CUT TO:

[INT. CSI - DNA LAB - DAY -- CONTINUOUS]

(Megan is looking through the scope. The door opens and Speedle walks in.)

SPEEDLE: Guess whose prints were on that busted bottle we found at the beach?
Paul Varnette, the boyfriend.

MEGAN: Paul touched a champagne bottle that ended up on the beach.

SPEEDLE: Champagne bottle's the murder weapon. I tested it.

(Quick flash of: [INT. CSI - LAB] Speedle puts a bit of the glass into a large
measuring tube. The two glass pieces float around 130 mark.)

SPEEDLE: (v.o.) Identical float density to the glass found on the dead guy's
neck.

(End of flashback. Resume to present.)

MEGAN: So, Paul catches his girl with Estevan.

SPEEDLE: Offs the guy, assaults the girl.

MEGAN: It's going to be hard to prove rape. Paul admitted he and Jane had
consensual sex yesterday.

SPEEDLE: What's the microscope say?

MEGAN: Ten spermatozoa per field of view. [SCOPE VIEW OF CELLS] Fifty percent
still have their tails. Timeline fits his story but that still doesn't explain
the oral cop. Retainer from Jane's mouth. Found skin on the inside of the
screw. Take a look at this.

(Megan puts a second slide sample under the scope.)

SPEEDLE: It could be her tongue.

MEGAN: Thin epidermis, lots of blood vessels and the sebaceous glands are
separate from the hair follicles. We're talking penis-- tore off.

SPEEDLE: Ouch.

MEGAN: You might want to get a good hold of yourself.

SPEEDLE: Why?

MEGAN: Still have to chop it up; confirm it's Paul's.

SPEEDLE: (shakes his head in disgust) Oh ...

(Speedle turns and leaves. Megan smiles.)

CUT TO:

[INT. CSI - LAB - DAY]

(Horatio examines the Cuban cigar under the magnifying glass. He takes a sample
of the tobacco and runs an analysis. He puts the sample in the machine.)

CUT TO:

[INT. CSI - INTERVIEW ROOM -- DAY]

(Inside the interview room, Paul Varnette waits nervously.)

[INT. CSI - OBSERVATION ROOM -- DAY]

(In the observation room, Megan looks up when Horatio enters the room. He hands
her the test results.)

HORATIO: I compared the burn residue on the male victim's face to the tobacco
in Paul's cigar.

MEGAN: High concentrations of lanthanum and uranium in both samples. Same
brand, same soil.

(Horatio looks through the window at Paul Varnette in the other room.)

HORATIO: That's right. So, Paul kills Estevan, puts the cigar out on his face
as a personal touch for stealing his girl.

(Quick flash of: [BEACH - NIGHT] Estevan is on the beach sand. Someone with a
cigar reaches down and digs the burning tip of the cigar into his cheek. He
cries out in pain.)

(End of flash. Resume to present.)

HORATIO: Staggers back to the guest house and sleeps the whole thing off.

MEGAN: One problem. I just ran the penile tissue from Jane's retainer --
compared it to Paul's DNA.

HORATIO: Mm-hmm.

MEGAN: It's not a match.

HORATIO: But his prints are on the murder weapon.

MEGAN: Maybe he didn't do this alone. Maybe he did the killing ...

HORATIO: ... While somebody else sexually assaulted his girlfriend.

HARD CUT TO BLACK.

(COMMERCIAL SET)

FADE IN.

[INT. CSI - INTERVIEW ROOM -- DAY]

(Megan, Horatio and Det. Fenwick interview Paul Varnette.)

MEGAN: We know you didn't do this alone.

PAUL VARNETTE: I didn't do anything.

HORATIO: Paul, in all of your photographs you're wearing the watch that you
purchased at the airport.

(Horatio puts the photo from the digital camera on the table in front of Paul.)

DET. FENWICK: We found the receipt in your room. Forty-nine bucks and water
resistant down to one hundred fifty feet.

(Everyone focuses on Paul's 'new' watch on his wrist.)

HORATIO: And now you're sporting that hunk of Switzerland.

MEGAN: Hmm, 13 thou worth of gold.

HORATIO: Paul ... I don't think you can afford a watch that expensive, do you?

(The door opens and Ryan Cutler, a lawyer, walks into the room.)

RYAN CUTLER: Everyone ... Ryan Cutler. I'm on retainer with the Hamilton's.
They asked me to represent you as a friend of the family.

HORATIO: Paul, if you buy into this the Hamilton's will hang you out to dry in
two seconds.

PAUL VARNETTE: Like you aren't?

RYAN: Paul, the less said ...

MEGAN: You're innocent? Explain it to us.

RYAN CUTLER: Stop goading him!

HORATIO: Paul ... this man is not your attorney. You did not hire him. This
is about you. This is your life.

RYAN CUTLER: Paul ...

HORATIO: Paul?

PAUL VARNETTE: It was kind of a gift.

MEGAN: From?

PAUL VARNETTE: (shakes his head and mutters) "Just one kiss ... just one kiss."
That's all he kept saying.

HORATIO: Who?

PAUL VARNETTE: Tyler Hamilton.

(Quick flash to: [PARTY - DAY] Tyler talks with Paul.)

TYLER HAMILTON: Come on, she gives me one kiss I'll trade you my watch. (Tyler
holds out his watch to Paul.) Come on! Just one kiss. I'll trade you my
watch.

(Tyler gives the watch to Paul who looks at it.)

(End of flashback. Resume to present.)

PAUL VARNETTE: Look, she was upset.

(Quick flash to: [PARTY - DAY] Paul talks with Jane.)

PAUL VARNETTE: Really, babe. It's no big thing. It's friends.

(Jane looks at Paul. She's not pleased. Tyler kisses Jane. She smiles at
Paul. Tyler walks away. Jane looks away and wipes her lips with her fingers.
She walks away from Paul.)

(End of flashback. Resume to present.)

PAUL VARNETTE: I told her I was sorry. I grabbed a bottle of champagne, I
said, "let's go."

(Quick flash to: [PARTY - DAY] Paul grabs a bottle of champagne off the bar
counter. He takes it to Jane. Upset, she grabs it from him and leaves.)

(End of flashback. Resume to present.)

PAUL VARNETTE: She grabbed the bottle and she walked off. I lost track of her.
I figured she went down to the beach. I stayed and I got drunk.

HORATIO: But you didn't follow her out to the beach.

PAUL VARNETTE: No. But I should have. I screwed up.

HORATIO: Yes, you did. Yes, you did. Had you not traded her, none of this
would have happened but that's the past.

RYAN CUTLER: Paul, let's go.

HORATIO: Paul? I need to take a look at your watch. If you want me to buy
your story, I need to look at that watch.

(Paul looks at Horatio. After a moment, he removes his watch and places it on
the table between them. Horatio nods.)

(Paul stands up and leaves.)

CUT TO:

[INT. CSI - DNA LAB -- DAY]

(Megan swabs the watch wrist band.)

(CGI Close-up of the links in the wrist watch and the skin cells caught between
the links. The cotton swab passes over the links and grabs ahold of the cells.)

(Megan lifts the swab and looks at it.)

(She puts a slide under the scope and looks at it.)

[Scope view of the skin cells]

(Horatio walks into the lab.)

HORATIO: Hmm ... what do you got?

MEGAN: Paul was telling the truth. Found three sets of male DNA on this watch.

(Megan shows Horatio the results.)

HORATIO: Okay. Separate out Paul and then cross-reference the unknowns with
Jane's retainer. Let's do that.

MEGAN: You got it.

(Megan leaves.)

CUT TO:

[EXT. HAMILTON ESTATE - DAY]

(A car pulls out of the driveway. As it makes it way down the road, the
oncoming CSI car swerves and blocks its path.)

(Drake Hamilton stops the engine. Horatio exits his vehicle. He's carrying an
envelope. He talks with Drake through the driver's open window.)

HORATIO: Drake?

DRAKE HAMILTON: Horatio.

HORATIO: I'm here for a DNA sample.

DRAKE HAMILTON: Have you got a warrant?

HORATIO: This is your opportunity to clear your name. I suggest you take it.

DRAKE HAMILTON: We have been through this, Horatio.

HORATIO: Yes, we have. Back when I was a green CSI and driver's side airbags
were standard issue. Lucky for you though, huh? Not so lucky for the young
girl you had in the car.

DRAKE HAMILTON: And I have never forgotten your help.

HORATIO: You know what I haven't forgotten? That chemical burn on your arm
from the airbag. And your watch imprint. I haven't forgotten those things
either.

DRAKE HAMILTON: Well, you have some memory.

(Horatio takes out the photo of Paul's watch and shows it to Drake.)

HORATIO: Seen this before?

DRAKE HAMILTON: Yeah, it's the watch I gave my nephew a few months ago. Where
did you find it?

HORATIO: There are skin cells embedded in the band.

DRAKE HAMILTON: Skin cells?

HORATIO: Did you know that our entire genetic code is stored in a single cell?
Now, in this case I have the DNA of two males one of which forced Jane Renshaw
to have oral sex and the other one is a close relative. Now, which one are you?

(Drake and Horatio stare at each other.)

(Finally, Drake reaches for his keys in the ignition.)

CUT TO:

[EXT. HAMILTON RESIDENCE - BACKYARD -- DAY]

(Tyler Hamilton talks with Horatio. Drake Hamilton is there.)

TYLER HAMILTON: I was with her on the beach. In a sexual way, you know?

HORATIO: Why didn't you mention this before?

TYLER HAMILTON: Paul's my friend. Besides, once I hit that mousetrap in her
jaw it was pretty much over.

HORATIO: That must have been disappointing, huh?

TYLER HAMILTON: Killed the mood. I'll tell you that much. I left her alone
out there. I went back to the guest house, went to bed.

HORATIO: You didn't see Estevan, the bartender, out there?

TYLER HAMILTON: No.

HORATIO: You got your clothes from that night?

TYLER HAMILTON: (nods) In the guest house.

HORAITO: I'm going to need them.

TYLER HAMILTON: Sure, if my uncle says it's okay.

DRAKE HAMILTON: Look, he's already admitted to a consensual act, Horatio. Let
it go.

HORATIO: A man was murdered out here.

DRAKE HAMILTON: Yes, but the girl is the one who'll pay. The press will eat
her alive. Protect her.

HORATIO: Are you suggesting that I protect a woman? That's rich.

CUT TO:

[EXT. HAMILTON ESTATE - FRONT DRIVE -- DAY]

(Horatio walks toward the open front gate.)

CALLEIGH: (o.s.) More Hamilton hardball?

(Horatio smiles. Calleigh is standing in front of the CSI vehicle and back to
wearing her normal shirt and jeans. She's carrying a small tube of plans. When
he meets up with her, she takes the blueprints out of the tubing.)

CALLEIGH: I'm officially over them. Can you forgive me for ever thinking they
were all that?

HORATIO: Well, I made the same mistake myself once. What do we have?

(Calleigh unrolls the plans on the car hood.)

CALLEIGH: Filed with the city. Public access ... so's the beach. And the
property line ends here.

HORATIO: What's this right here?

(He points.)

CALLEIGH: Boardwalk dock.

HORATIO: It's also a public access. We'll take that.

CUT TO:

[EXT. PUBLIC ACCESS BEACH JUST OUTSIDE THE HAMILTON PROPERTY LINE -- DAY]

(Carrying their kits, Calleigh and Horatio head for the Boardwalk doc just
outside the Hamilton Property Line. They reach the boardwalk dock.)

HORATIO: Wait a minute. (Horatio sees something.) I've got blood drops right
here. (Calleigh kneels down behind Horatio and looks at the blood drops.) More
over there.

(Camera close-up of the blood drop.)

CALLEIGH: Pattern's exclamation points. Spines point in the direction of
travel.

(She points to the Hamilton House in front of them.)

HORATIO: Yes, they do. And this being the public access ... ours for the
taking.

(Calleigh is already digging inside her kit. Horatio stands up and looks out at
the Hamilton house in front of him.)

CUT TO:

[INT. CSI - HALLWAY -- DAY]

(Megan walks out of the lab and into the hallway.)

MEGAN: Horatio!

(Horatio heads toward Megan. They walk down the hallway.)

MEGAN: The blood you found belongs to Estevan Ordonez. Of course, we can't
tell if it's from him or someone with his blood on them.

HORATIO: Okay, but it doesn't matter because a murdered man's blood leads up to
the Hamilton house. We got the warrant.

(Horatio and Megan walk out of camera frame.)

CUT TO:

[EXT. HAMILTON ESTATE - BACKYARD -- DAY]

(We hear the beeping of heavy machinery. Horatio and Megan turn the corner of
the house and enter the backyard. We hear the sounds of the engines from heavy
machinery.)

(Drake Hamilton looks at the warrant.)

(Horatio spots it and takes off.)

HORATIO: Hey... hey!

(Horatio runs toward the machines that are demolishing the guest house. The
building is already in rubble, but isn't completely decimated.)

(Horatio stops in front of Tyler Hamilton who stands there watching the machines
destroy the guest house.)

(Horatio watches the machines and nods. He turns and glances at Drake Hamilton
who fiddles with the warrant in his hands.)

HARD CUT TO BLACK.

(COMMERCIAL SET)

FADE IN

[EXT. HAMILTON ESTATE - BACKYARD -- DAY]

(Open on the demolished guest house. Calleigh, Delko and Speedle are sifting
through everything.)

DELKO: We're not even sure what we're looking for.

CALLEIGH: We never are, but I'd be happy with Tyler's clothes from that night--
a shirt shoes, anything.

(Calleigh kneels down and sees a piece of scrap material with burned edges.)

CALLEIGH: Unless, of course

(She picks up the scrap piece of cloth.)

CALLEIGH: ... he already burned them.

SPEEDLE: You know what that means. Dig in.

CUT TO:

[EXT. HAMILTON ESTATE - BACKYARD -- DAY]

(Horatio puts on a pair of latex gloves. Drake Hamilton is sitting down while
his lawyer, Ryan Cutler, stands guard over them.)

HORATIO: That's one way to bury your past.

RYAN CUTLER: They've had plans to put in a tennis court for months. Check with
the contractor.

HORATIO: Oh, we are, believe ..

DRAKE HAMILTON: Horatio, if I had known...

HORATIO: (flatly) You knew. (to MEGAN) I want a DNA sample from both of them
just because we can, okay?

MEGAN: Yep.

(Horatio leaves. Megan takes a swab and approaches Tyler Hamilton who has a
very smug look on his face.)

MEGAN: Open wide. Relax. I won't jam it in too hard.

(He opens his mouth and she takes the swab sample.)

(Horatio stands at the edge of the demolished house. He looks down at the wreck
in front of him. He sees something.)

(He kneels and pulls out a damaged box of Cuban cigars. He picks up the end of
a cigar. He puts it in his palm and sees that the tip of the cigar is used.)

(He stands up holding the cigar stub. He looks over and sees Tyler Hamilton
playing croquet.)

HORATIO: I'm going to head back to the lab, guys.

CALLEIGH: Okay.

HORATIO: I'll see you there.

(Horatio leaves.)

(Calleigh finds something.)

CALLEIGH: Hey, guys.

(In the rubble, Calleigh spots a zipper.)

CALLEIGH: Hamilton men -- try as they might -- cannot hide their zippers.

(She picks up the zipper to show them.)

SPEEDLE: Very carefully, please.

(She puts the zipper into the tin that Delko holds open.)

CUT TO:

[INT. CSI - LAB -- DAY]

(Speedle share the results of the zipper analysis with Horatio.)

SPEEDLE: Zippers from a guy's medium-sized warm-up jacket manufactured by Fubu.
It's the same kind that Tyler was wearing the night of the party according to
the pictures from homicide.

(Speedle shows the picture to Horatio.)

HORATIO: You look for trace?

SPEEDLE: Isolated fragments of glass in the zipper teeth.

(Extreme close up of the zipper shows bits of green glass stuck inside.)

SPEEDLE: Glass melts at 2,700 degrees Fahrenheit.

HORATIO: Yes, but a wood fire only gets up to a thousand and the Hamilton's
couldn't have known that.

SPEEDLE: Density matches the murder weapon.

HORATIO: Tyler clobbers the guy

(Quick flash of: [BEACH - NIGHT] Estevan's hit on the back of the head with a
blunt object.)

(End of flash. Resume to present.)

HORATIO: ... and glass rains down on his jacket.

(Quick flash of: Bits of the glass shatters and falls on the jacket getting
caught in the zipper teeth.)

(End of flash. Resume to present.)

SPEEDLE: It's weird how one kiss can turn into such a mess.

(Megan walks into the room and clears her throat.)

MEGAN: The cigar you asked me to process from the guest house. Same tobacco as
the burn on Esteban's face. Saliva -- Tyler's. And the material in the end?
Silica.

HORATIO: A.k.a. beach sand. Let's go talk to the young Mr. Hamilton. Nice
going.

(Megan and Horatio leave the lab. As he leaves, Horatio spots Calleigh in
another lab talking with Surfer, the DNA Technician.)

CUT TO:

[INT. CSI - INTERVIEW ROOM -- DAY]

(Horatio, Megan and Det. Fenwick interviews Tyler with Ryan Cutler in the room.)

HORATIO: So, Tyler, you pony up the $1,300 watch for just one kiss and the
young lady runs off with the bartender anyway.

(Quick flash of: [PARTY - NIGHT] Tyler sees Jane sitting on the side with
Estevan.)

(End of flash. Resume to present.)

MEGAN: That kiss is going to cost you a lot more than a watch.

(Quick flash to: [PARTY -NIGHT] Tyler sees Estevan return in a shirt and
jeans. He joins Jane and they leave together.)

MEGAN: (v.o.) So, what ... the bartender changes into his street clothes and
the girl walked off with him?

(As he watches, Estevan opens the small gate leading to the boardwalk dock. He
watches them leave together.)

(Tyler takes a deep breath from his cigar.)

HORATIO: (v.o.) You just went out there to razz the guy for stealing your
girl.

(Dressed with the hood of his jacket over his head, Tyler comes upon Estevan and
Jane kissing on the beach.)

HORATIO: (v.o.) But once you saw that lowly bartender kissing the girl who
blew you off the old Hamilton arrogance turned into rage.

(Tyler walks up to them and hits Estevan on the back of the head. Estevan and
Tyler fight. Jane screams. Finally, Tyler attacks Estevan with the champagne
bottle.)

(End of flashback. Resume to present.)

HORATIO: And you have what you claim to be consensual sex.

(Quick flash of: Tyler climbs on Jane and forces her mouth open. He unzips.
She struggles.)

JANE RENSHAW: Oh, no!

(End of flashback. Resume to present.)

HORATIO: And then you leave the young woman alone to die in the water.

(Quick flash of Jane face-up in the edge of the on-coming tide. End of flash.
Resume to present.)

TYLER HAMILTON: If you say so.

HORATIO: But that wasn't enough. You go the extra yard and you burn the man's
face.

(Quick flash of: [NIGHT] Tyler walks up to Estevan on the beach. He takes out
his cigar and digs it into Estevan's right cheek. Estevan cries out in pain. )

(End of flashback. Resume to present.)

MEGAN: He ran, you caught up and you cut his throat with what was left of that
champagne bottle.

(Megan opens the file in front of her and pushes a photo across the table.
Tyler leans forward.)

TYLER HAMILTON: (smugly) You're way off.

HORATIO: Then why don't you educate us?

(Tyler turns to look smugly at Horatio. Calleigh knocks lightly on the door.)

HORATIO: Excuse me.

(Horatio turns and walks out of the lab into the hallway with Calleigh. Megan
also steps out of the room.)

HORATIO: I know this is going to be good. What's going on?

CALLEIGH: Tyler Hamilton doesn't wear glasses.

HORATIO: Excuse me?

CALLEIGH: The nosepiece from the glasses at the crime scene? Surfer in DNA
triple-checked it. Found blood from our dead guy on it.

MEGAN: Transfer or spatter?

CALLEIGH: Direct spatter, medium force.

MEGAN: (sighs) The only way you get spatter on a nosepiece is to be there when
the murder's happening.

CALLEIGH: I know. But Tyler Hamilton doesn't wear glasses so it can't be
Tyler's nosepiece.

HORATIO: Drake wears glasses. Bring him in.

CALLEIGH: Okay.

HORATIO: Thank you.

(Calleigh leaves.)

CUT TO:

[INT. CSI - HALLWAY -- DAY]

(The elevator doors open. Drake Hamilton steps out of the elevator into the
hallway.)

HORATIO: (o.s.) Drake.

DRAKE: Yes, Horatio.

HORATIO: I'm going to need your glasses.

DRAKE: For what?

HORATIO: Either you take them off or I'm going to take them off you. You
decide.

(After a moment, Drake removes his glasses and hands them to Horatio.)

HORATIO: Good decision. Now sit down. Hmm.

(Horatio leaves.)

CUT TO:

[INT. CSI - LAB -- DAY]

(Horatio takes the lens out from the glasses and examines the edge. He sees the
blood stain. He swabs the stain and tests the swab for blood. The swab turns
pink.)

CUT TO:

[INT. CSI - INTERVIEW ROOM -- DAY]

(With his lawyer by his side, Drake looks at the photo of the lens. The
evidence tag reads:
     EVIDENCE
     HC-01
     CASE # 492138-A
     HC-37

HORATIO: You did this.

(Drake sees the stain on the edge of the lens.)

HORATIO: In an attempt to wipe away the blood, Drake, you merely pushed it to
the corner of your lens.

(Quick flash of: [NIGHT] Drake takes off his glasses and wipes the blood off.)

(End of flashback. Resume to present.)

HORATIO: So, slit jugular wet blood, you had to be inches away.

(Quick flash of: [NIGHT] Drake uses the champagne bottle and cuts Estevan's
throat as they struggle.)

(End of flashback. Resume to present.)

(Drake stares at Horatio. He hands the photo over to his lawyer.)

DRAKE: I, um ... I heard a scream.

(Quick flash of: [NIGHT] Drake walks along the balcony when he hears a woman
scream.

(End of flashback. Resume to present.)

DRAKE: And by the time I got down to the beach...

(Quick flash of: [BEACH - NIGHT] Drake runs out to the beach and sees Tyler
fighting with Estevan.)

(He looks over and sees Jane face-up in the water.)

(In the struggle, Estevan gets the hood off of the assailant and instantly
recognizes him.)

ESTEVAN ORDONEZ: Mr. Hamilton? Hamilton?!

(Estevan gets up off of Tyler. He backs away and sees Drake standing off to the
side.)

ESTEVAN ORDONEZ: Mr. Hamilton?

(He starts crying out for help.)

ESTEVAN ORDONEZ: Somebody help!

DRAKE HAMILTON: No, no, no! Wait, wait, wait!

ESTEVAN ORDONEZ: Someone help! Help! There's been a murder! Somebody help!
Somebody help me!

(In an attempt to stop Estevan from yelling, Drake picks up the broken champagne
bottle and attacks Estevan.)

(End of flashback. Resume to present.)

(Drake looks at Horatio. They say nothing. They all know what happens next.)

(Quick flash of: [BEACH - NIGHT] Drake struggles with Estevan.)

ESTEVAN ORDONEZ: Help!

(With a hand over Estevan's mouth, Drake cuts his throat. Blood splashes onto
his face. In the struggle, Drake's glasses fall off. Drake wipes at the blood
with the back of his hand.)

(He leaves Estevan with his throat bleeding out.)

(Drake picks up his bloodied glasses, the nose piece left in the sand.)

(Flash to: Drake and Tyler head back to the house on the boardwalk dock.)

TYLER HAMILTON: Sorry, unc.

DRAKE HAMILTON: Shut up. Get out of those clothes.

(As they head for the house, Drake has the broken champagne bottle in his hand.)

(Cut to: [GUEST HOUSE] Drake burns the clothes in the fireplace.)

(End of flash. Resume to present.)

RYAN CUTLER (LAWYER): Again, you have made this statement against my counsel.

DRAKE HAMILTON: Oh, let it go, Cutler.

RYAN CUTLER (LAWYER): You're looking at life. Are you aware of that?

HORATIO: Without parole.

(Drake looks at Horatio and says nothing.)

HORATIO: What a waste. What a waste.

DRAKE HAMILTON: You said ... our entire genetic makeup ... is in one cell. How
do we escape that?

HORATIO: Your family? You stop procreating.

(An officer steps up. Drake stands up.)

CUT TO:

[INT. CSI - HALLWAY -- CONTINUOUS]

(An officer escorts Drake Hamilton and Det. Fenwick escorts Tyler Hamilton out
of the rooms. They lead the two men down the hallway.)

(Calleigh watches them walk by, then she turns and heads back into the lab.)

CUT TO:

[EXT. MIAMI CITY (STOCK) - DAY]

[INT. AGRAMONTE - JANE'S ROOM -- DAY]

(Jane finishes up her phone call.)

JANE RENSHAW: (to phone) Thank you.

(She hangs up and looks at Megan who is standing out on the balcony.)

JANE RENSHAW: Taxi's downstairs.

MEGAN: I'll walk you.

(Jane walks over to her bag and closes it when Paul walks into the room.)

PAUL VARNETTE: Jane.

(Jane grabs her bags.)

MEGAN: Bad idea, Paul.

PAUL VARNETTE: Can I talk to you ... please?

(Megan looks at Jane. She doesn't look like she wants to say anything to Paul.)

MEGAN: I'll meet you in the lobby.

(Jane takes her bags and leaves the room.)

PAUL VARNETTE: I had no idea Tyler was going to hurt her. She has to know
that. I love her.

MEGAN: If you loved her, you wouldn't have traded her for a watch.

(Megan leaves the room. Camera holds on Paul.)

CUT TO:

[EXT. -- DAY]

(Horatio is reading the paper. The article headline reads: HAMILTONS ARRESTED
IN RAPE MURDER.)

(He puts the paper down when Megan walks up to his table.)

MEGAN: Hey. Mind if I join you?

HORATIO: Not at all.

(Megan sits down.)

MEGAN: Hamiltons are all over the tv tube.

HORATIO: Deja vu.

MEGAN: The old case?

HORATIO: Mm-hmm. Fifteen years ago.

(Megan shakes her head.)

MEGAN: I wasn't on the job then.

HORATIO: Hmm.

(Horatio leans forward.)

HORATIO: (flatly) July 25th, 1987. I found Drake Hamilton's car by the side
of the road after a terrible accident. Girl in the front seat dead. No Drake.
Went up to the Hamilton residence where I was received like a diplomat -- glad-
handing, promises, blah-blah-blah -- "Drake'll be right down." Well, he did come
down four hours later with three attorneys in tow and a story about how Drake
lent the girl the car. So with no clothes at the scene solid alibi and a
mysterious chemical burn on his forearm we had nothing. No charges were ever
filed. He walked. No investigation. M.E. later told me that the girl bled out
and that all he had to do was call 911 from the road and she would have lived.
He didn't do that.

MEGAN: Horatio, you got him now.

HORATIO: Got him now. I would have nailed him fifteen years ago, though.

MEGAN: Let's hope for the next one.

HORATIO: Hmm. (nods) Let's do that.

FADE TO BLACK.
